Location: Beijing/Shanghai
The position
1. Oversee NN's patent portfolio in China
- Secure optimal patent protection for NN in China through prosecution, by close collaboration with Global Patents and in-depth industry knowledge, especially for the critical patents;
- Defend for NN patent validity challenges from any third party after aligning with business strategy, and exhaust any possible legal means when necessary;
- Provide relevant patent support to Global Patents, including relevant FTO analysis, patent practice consulting, patent application reviewing, etc;
- Monitor the patent system development in China and advocate for further improvement.
2. Provide IP support to business with cross functional efforts
- Provide patent support to business and drive the good practice to collaborate with Region China, including patent listing, PTE, etc;
- Provide regular patent update to key stakeholders and management in Region China;
- Lead the advocacy efforts to support patent protection cases and regulatory exclusivity including RDP, by close collaboration with cross functional team;
- Leverage patent rights to support the relevant VBP and other procurement negotiation;
- Monitor biosimilar activity and leverage patents including secondary patents to support differentiation from biosimilars.
3. Drive the enforcement actions with collaboration with Global Litigation
- Drive the Patent Linkage action against the biosimilars' non-compliance together with Global Litigation;
- Drive the enforcement actions against API infringement together with Global Litigation when relevant;
- Drive the enforcement actions against biosimilars for national or provincial procurement process, by closely working together with Region China and Global Litigation.
Qualifications
• Relevant technical background, at least at master level in life sciences relevant;
• Excellent English and Chinese skills both verbally and in writing;
• Extensive knowledge of patent procedures and patent laws in China;
• Extensive knowledge of patenting in the pharmaceutical field;
• Worked at least 10 years as patent attorney in a patent firm, a corporate patent department or patent office;
• Extensive knowledge of patent procedures and patent laws in other major jurisdictions outside of China preferred;
• Demonstrated ability to independently handle complex patenting issues, where substantial innovation is required;
• Demonstrated ability to lead the team.
